TERMS AND CONDITIONS

The fine print — here’s what you need to know about using Stable Stakes.

Important Information​

To enter a Stable Stakes, you must be over 18 years of age and possess a valid UK golf handicap registered in your name.

By entering your first Stable Stakes, you become a Stable Stakes Competitor, and your entry is accepted by the Company as a legally binding agreement to observe and comply with these terms and conditions (the "Terms"). This constitutes your Contract with the Company.

Words in italics and the interpretation of this document are as defined and provided for in these Terms and Conditions.

Definitions and Interpretation​

1.1 In these Terms:

  • Stable Stakes refers to a game for amateur golfers to a) perform better than or match their golf handicap, and/or b) achieve a specific Handicapping Score in any 18-hole stableford competition held in the UK on any given day. It also serves as the name of the Company’s website, mobile applications, and is the trading name held by XXXXX EVEN Golf Ltd XXXX Company Number VAT NUMBER REGISTERED ADDRESS (PENDING SETUP)

  • Stable Stakes Games means a daily game conducted by the Company in which Stable Stakes Competitors participate in one, two or three selected games if they also play in their club competition on that day. If Stable Stakes Competitors participate in more than one club competition on any given day, they may enter the daily Stable Stakes games but must use the first game or games they play that day for one or both of the Stable Stakes offered on the Stable Stakes Website. Stable Stakes competitors may enter more than one game, but both of these must be entered prior to the start of any club competition.

  • Stable Stakes Competitor refers to a person who is over 18 years of age and enters a Stable Stakes game.

  • Stable Stakes Competitor's Prize Account refers to the running account maintained by the Company on the Stable Stakes Website and app, which tracks the value of winnings earned and redeemed by Stable Stakes Competitors from time to time.

  • Stable Stakes Services refers to the services provided by the XXX COMPANY XX through the Stable Stakes Website.

  • Stable Stakes Website refers to the Company's website and mobile applications.

  • Committee means a "Committee" as defined in the Rules of Golf.

  • Competition refers to a golf stroke play competition in which each competitor plays individually and which is:

    • held in the UK,

    • played over 18 holes,

    • conducted in accordance with the Rules of Golf,

    • and the results of which are used for the computation of official golf handicaps. “Stroke play” has the meaning described in the Rules of Golf (see Rule 3) and includes competitions played in bogey, stableford, and par formats.

  • Competitor refers to a person who is over 18 years of age and is an “amateur golfer” as defined in the Rules of Golf, who holds a valid UK golf handicap registered in their name.

  • Conditions of Play (or "COPs") means the rules and conditions that apply to all Stable Stakes.

  • Consideration refers to the amount staked by each Stable Stakes Competitor for each game they enter, along with the agreement by the Company to award winnings to Stable Stakes Competitors who succeed in those games.

  • Contract refers to the agreement made between each Stable Stakes Competitor and the Company, based on the terms and conditions set out in the Contract Documentation.

  • Contract Documentation refers to all materials that form the Contract, including, without limitation, these Terms, the COPs, other materials published by the Company on the Stable Stakes Website (such as policies and guidelines), and the details provided by each Competitor when they enter a Stable Stakes and thereby become a Stable Stakes Competitor.

  • Handicap refers to the official golf handicap of a player, which is computed in accordance with the World Handicap System (WHS).

  • Rules of Golf means the Rules of Golf and the Rules of Amateur Status as approved and published by the R&A Rules Limited in the edition current at the time of each Stable Stakes.

  • Terms refers to the terms and conditions set out in this document.

  • Winnings refers to the prizes won in Stable Stakes, expressed as a monetary value in the Competitor's Prize Account, which can be redeemed exclusively via the Stable Stakes Website. Winnings cannot be redeemed for cash.

 

1.2 Unless the context otherwise requires:
  • Clause and subclause headings are for reference purposes only;

  • The singular includes the plural and vice versa;

  • Words denoting any gender include all genders;

  • Reference to a "person" includes individuals, corporations, and any other legal entities recognised by UK law, and vice versa;

  • Where a word or phrase is defined, its other grammatical forms carry a corresponding meaning;

  • Any reference to a person includes their successors and permitted assigns;

  • Any reference to two or more persons includes each of them jointly and severally;

  • References to time are to UK local time;

  • Where the day on or by which something is to be done is not a Business Day, it must be done on or by the next Business Day;

  • A reference to any organisation or body, other than a party to this agreement (including an institute, association, or authority), whether statutory or not:

    • That ceases to exist, or

    • Whose powers or functions are transferred to another body, refers to the body that replaces it or substantially succeeds to its powers or functions.

 

2. Contract​

2.1 Each Stable Stakes Competitor and the Company enter into a Contract from the date and time the Stable Stakes Competitor enters a Stable Stakes.

2.2 Each Stable Stakes Competitor warrants to the Company that they are at least 18 years of age and are qualified and entitled to participate in Competitions.

2.3 The Consideration refers to the payment or stake made by the Competitor, which forms the basis of the Contract.

2.4 In the event of any conflict between the Terms and any other provision of the Contract Documentation, these Terms shall prevail.

2.5 The Company reserves the right to add to, amend, replace, or vary the Terms, the Conditions of Play (COPs), and any other Contract Documentation at any time, with or without notice to Stable Stakes Competitors. Any continued use of the Stable Stakes Services after such changes constitutes acceptance by the Competitor of the updated Terms.

2.6 Stable Stakes Competitors acknowledge, agree, and accept that their Consideration is non-refundable and that under no circumstances will any Consideration paid be recoverable from the Company. However, if Competitors become aware of any errors in calculations relating to any transaction, they must inform the Company promptly. The Company may offer a refund or credit if it considers there has been a transaction error or if such a remedy is justified for other reasons.

2.7 Stable Stakes Competitors agree to use the Company’s Website and services solely for legitimate purposes and must not engage in any activity intended to cause harm to, or hinder, the Company’s business operations, or that could generate or increase the Company’s liability, including but not limited to any tax, levy, or duty.

 

3. Integrity

3.1 Stable Stakes relies on the integrity of all participants in its golf games to play and submit their scorecards in accordance with the Rules of Golf as set out by the Royal & Ancient Golf Club of St Andrews and relevant UK governing bodies.

3.2 Both Stable Stakes and its participants also rely on the accuracy of participants' results as recorded in their official handicap systems, as recognised by UK golfing authorities.

3.3 By entering any Stable Stakes, each participant undertakes to play, score, and submit their scorecards in strict adherence to the Rules of Golf, and not to engage in any conduct that would distort the results of the game or their handicap record for personal gain or any other improper purpose.

3.4 Participants acting as markers for another participant's scorecard must comply fully with the Rules of Golf and ensure the integrity of the competition by not manipulating any part of the game or the results that may affect the competitor’s handicap record or the outcome of the competition

3.5 We reserve the right to regularly audit Stable Stakes competitors handicaps, rounds and scores. This is done with statistical auditing software to isolate any irregularities with scores, patterns of scores and results in accordance with odds v playing ability (handicap). We have established relationships with Golf bodies and golf clubs to ensure appropriate handicaps are applied at the time of entry to any Stable Stakes game. CONFIRM WITH GOLF BODIES

 

4. Term​

4.1 The contract between Stable Stakes and each participant remains in effect unless and until terminated by Stable Stakes in accordance with these terms.

4.2 Stable Stakes reserves the right to terminate the contract with any participant if it reasonably believes that the participant has breached, or is in breach of, any of the terms and conditions of participation.

 

 

5. Governing Law and Jurisdiction​

5.1 This contract is governed by and shall be construed in accordance with the laws of England, Wales, Scotland, and Northern Ireland.

5.2 Both parties irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of England, Wales, Scotland, and Northern Ireland in relation to any dispute or claim arising out of or in connection with this contract and waive any right to object to proceedings being brought in those courts.

 

6. Licence to Use the Stable Stakes Website

6.1 Stable Stakes grants individuals wishing to become Stable Stakes Competitors a limited, non-exclusive licence to use the Stable Stakes Website solely for the purpose of entering Stable Stakes competitions.

6.2 Stable Stakes further grants Stable Stakes Competitors a limited, non-exclusive licence to access their Prize Account via the Stable Stakes Website and to redeem any winnings.

6.3 Stable Stakes Competitors acknowledge, agree, and accept the following:

6.3.1 Their use of the Stable Stakes Website does not confer any rights to the content or any associated intellectual property rights in relation to the Stable Stakes Website.

6.3.2 They must not, and must not attempt to:

  • Monitor, use, or copy any pages or content from the Stable Stakes Website;

  • Hack, make unauthorised alterations, or introduce any form of malicious code to the Stable Stakes Website;

  • Reverse engineer or decompile (in whole or in part) any software available through the Stable Stakes Website;

  • Make copies, modify, reproduce, transmit, alter, or distribute all or any part of the Stable Stakes Website or any materials or information contained within it;

  • Disguise or interfere with the IP address of the computer used to access the Stable Stakes Website or take any steps to prevent Stable Stakes from accurately identifying the actual IP address of the accessing computer.

 

6.3.3 To ensure proper functionality of the Stable Stakes Website, users must ensure that their browser settings allow for "cookies" and that JavaScript is enabled.

 

7. Assignment

7.1 Stable Stakes Competitors may not assign or transfer any of their rights under this Contract, including any rights to Winnings or to their Stable Stakes Competitor’s Prize Account, without the prior written consent of the Company.

7.2 The Company may assign or transfer any or all of its rights or obligations under this Contract to a third party at any time without prior notice to Stable Stakes Competitors.

 

8. Continuation

8.1 Any provision of this Contract that is intended by its nature to continue after termination shall remain in full force and effect following such termination.

 

9. Invalidity, Unenforceability, and Severance

9.1 If any provision of this Contract is found to be invalid or unenforceable:

(a) it shall be deemed modified to the minimum extent necessary to make it valid and enforceable; or, if such modification is not possible.

(b) it shall be severed from this Contract, and the remaining provisions shall continue in full force and effect.

 

10. Entire Agreement and Further Assurances

10.1 The Contract Documentation constitutes the entire agreement between each Stable Stakes Competitor and the Company in relation to its subject matter and supersedes all prior discussions, agreements, or understandings, whether written or oral.

10.2 Each Stable Stakes Competitor confirms that they have not entered into this Contract in reliance on any warranty (including, but not limited to, any warranty of merchantability, fitness for purpose, or uninterrupted functionality), representation, statement, assurance, covenant, agreement, undertaking, indemnity, or commitment of any kind, except as expressly set out in the Contract Documentation. To the extent that any such reliance has occurred, the Competitor irrevocably and unconditionally waives any rights, claims, or remedies that they might otherwise have had in relation thereto, to the fullest extent permitted by law.

10.3 Each party shall promptly take all necessary actions, including executing and delivering any further documents required by law or reasonably requested by the other party, to give full effect to this Contract.

 

 
11. No Waiver

11.1 No failure or delay by the Company in exercising any of its rights under this Contract shall constitute a waiver of those rights, nor shall any single or partial exercise of any right preclude any other or further exercise of that or any other right. Furthermore, any such failure or delay shall not give rise to any claim or right of action by any Stable Stakes Competitor or any other person.

 

 

12. Notices

12.1 Stable Stakes Competitors may give notices to the Company either electronically via the "Contact us" section of the Stable Stakes Website, by hand, or by prepaid post to the Company’s registered office, or by email to an email address specified by an authorised officer of the Company.

12.2 The Company may give notices to Stable Stakes Competitors electronically via the Stable Stakes Website for generic notices, or by hand, prepaid post addressed to the Competitor’s last known address, or by email to the Competitor’s last known email address, as notified to the Company (typically via the Stable Stakes Website).

12.3 All notices must be:

(a) in legible writing and in English;
(b) correctly addressed; and
(c) signed by the party giving the notice or making the communication, if applicable.

12.4 Notices sent by prepaid post must be sent by airmail if addressed to a recipient outside of the United Kingdom.

12.5 Without limiting other means of proving that a notice has been received, a notice will be deemed to have been received:

(a) if delivered by hand, at 9:00 am (recipient’s local time) on the next business day at the recipient's address;
(b) if sent by prepaid post, three business days after posting within the UK or ten business days if posted internationally;
(c) if sent via the Stable Stakes Website, when posted on the website; and
(d) if sent by email, upon receipt of an acknowledgement or receipt confirmation from the recipient.

 

 

 

13. Minimum Age

13.1 The Company accepts no responsibility for entrants who are under the minimum legal age required to participate. The Company reserves the right to cancel any Stable Stakes Competitor’s Prize Account if it reasonably believes the account holder is under-age.

13.2 The Company may also refuse to issue Winnings to any person accepted as a Stable Stakes Competitor if it has reason to believe that person is under the minimum legal age.

 

 

14. Stable Stakes Competitors’ Website Responsibilities

14.1 Stable Stakes Competitors are responsible for all entries they make on the Stable Stakes Website.

14.2 Any transaction made via the Stable Stakes Website that requires a Competitor to log in using their unique password will be considered valid by the Company.

14.3 Stable Stakes Competitors are responsible for understanding the content of the Stable Stakes Website and how the services offered on it operate.

14.4 The Company reserves the right to change the format of the Stable Stakes Services at any time, including making enhancements.

 

15. Personal Information and Privacy

15.1 The Company will collect, store, and disclose Stable Stakes Competitors’ personal information in accordance with the UK Data Protection Act 2018 and the General Data Protection Regulation (GDPR), as detailed in the Privacy Policy published on the Stable Stakes Website, which forms part of the Contract Documentation.

15.2 Stable Stakes Competitors warrant and represent to the Company that any personal information they provide is true, accurate, and complete, and they agree to maintain the accuracy of their information.

15.3 Upon the Company's request, Stable Stakes Competitors must provide evidence satisfactory to the Company to verify the truth, accuracy, and completeness of their personal information.

15.4 The Company will take reasonable steps to:

(a) ensure that the personal information it collects, uses, or discloses is accurate, complete, and up to date;
(b) protect the personal information it holds from misuse, loss, or unauthorised access, modification, or disclosure; and
(c) destroy or permanently anonymise personal information when it is no longer needed for the purposes for which it was collected, in accordance with data protection regulations.

15.5 Stable Stakes Competitors acknowledge and agree that their personal information may be used or disclosed by the Company as follows, in accordance with data protection laws and the Company’s Privacy Policy. Personal information may be collected, stored, used, or disclosed:

(a) to enable the Company to perform its obligations under this Contract;
(b) to ensure that Stable Stakes Competitors comply with their obligations under this Contract;
(c) to a credit reporting agency and to maintain a credit information file about the Competitor;
(d) to perform the Company’s own credit assessments on the Competitor;
(e) for planning, research, promotion, and marketing of the Company’s products and services;
(f) to organisations associated with the provision of the Company's services, including for marketing and analysis purposes;
(g) to potential purchasers or investors in the Company’s business;
(h) where the Company is required by law to do so, or where disclosure is reasonably necessary to enforce the law;
(i) to assist government agencies with lawful enquiries, such as HMRC or child support agencies;
(j) to comply with the Company’s disclosure obligations to sporting bodies, in accordance with any contractual obligations;
(k) to comply with the Company’s legal and regulatory obligations; and
(l) to protect the Company’s rights or property, or those of any other website user, Stable Stakes Competitor, or member of the public.

15.6 Stable Stakes Competitors may request access to their personal information held by the Company by providing written notice.

15.7 If a Stable Stakes Competitor does not provide the Company with any information (including personal information) that the Company reasonably requires, the Company may, at its discretion, suspend or close the Competitor’s account.

15.8 Each Stable Stakes Competitor acknowledges and agrees that they may only hold one Stable Stakes Competitor's Prize Account.

 

16. Operation of Stable Stakes Services

16.1 The Company reserves the right to determine when Stable Stakes are open or closed for entries and may modify the "Results Cut-off Time" and "Consideration Cut-off Time" as defined in the Contract or the Competition Operating Procedures (COPs) at any time.

16.2 If the Company deems it necessary to maintain integrity and fairness, it may, in relation to any Stable Stakes, suspend entries, void certain entries, or void the game in its entirety.

17. Cancellation, Termination, Suspension, and Breach

17.1 The Company may restrict a Stable Stakes Competitor’s access to the Stable Stakes Services, suspend or terminate any account they hold with the Company, withdraw their entries, or void or cancel any outstanding entries or Winnings, and terminate the Contract if:

(a) there is a technological failure;
(b) the Company suspects that the Stable Stakes Competitor is engaging in illegal or fraudulent activity;
(c) the Company suspects that the Stable Stakes Competitor has (or may have) breached any provision of the Contract Documentation; or
(d) the Company suspects that the Stable Stakes Competitor is acting in a manner detrimental to the conduct of the Company's business or which may result in legal liability for the Stable Stakes Competitor, the Company, or any third parties.

17.2 In relation to any cancelled or void entries, the Company reserves the right to demand payment for and recover from the Stable Stakes Competitor any outstanding amounts relating to those entries.

18. Entries and Acceptance

18.1 Entries for Stable Stakes must be made in accordance with the provisions set forth in the Competition Operating Procedures (COPs).

18.2 The provisions of the COPs shall apply to all entries.

18.3 Once submitted and accepted, an entry into a Stable Stakes may not be altered or cancelled except as permitted under the Contract.

18.4 The maximum and minimum values of Winnings that may be awarded in a Stable Stakes are subject to change and may be amended by the Company at any time. Any such changes will be communicated to Stable Stakes Competitors via the Stable Stakes Website.

 

19. Dishonoured Payments

19.1 If a credit or debit card payment made by a Stable Stakes Competitor is dishonoured after authorisation has been received from the relevant financial institution, all Winnings that have accrued and remain in that Stable Stakes Competitor’s Prize Account, or which are due to be credited to that account, shall be suspended until such time as the dishonoured payment is rectified.

19.2 If the payment remains dishonoured:

(a) all Winnings that have accrued and remain in the relevant Stable Stakes Competitor’s Prize Account, or which are due to be credited to that account in relation to the dishonoured payment, shall not be redeemable and will be forfeited to the Company; and


(b) the Stable Stakes Competitor must reimburse the Company for any Winnings obtained from the dishonoured payment(s). Should the Stable Stakes Competitor fail to comply with this obligation, the Company reserves the right to recover these amounts from the Competitor, and any sums recovered will belong to the Company.

 

20. Rounding

20.1 All Winnings will be rounded down to the nearest whole pound.

20.2 The rounding will occur after the Winning amount has been calculated.

 

21. Payments 

21.1 The Company has engaged CONFIRM PAYMENT PROCESSOR, to manage and collect credit and debit card payments of Consideration and any other amounts payable by credit or debit card for Stable Stakes Services. 

21.2 Stable Stakes Competitors acknowledge that the Company does not possess or retain any usable information relating to the credit or debit cards of Stable Stakes Competitors.

 

22. Matters Beyond Reasonable Control

22.1 The Company shall not be liable for any loss or damage suffered by any person, including Stable Stakes Competitors, arising from any act of God; power cut; trade or labour dispute; act, failure or omission of any government or authority; obstruction or failure of telecommunications or internet services; or any other delay, interruption or failure beyond the control of the Company. In such events, the Company reserves the right to cancel or suspend the Stable Stakes Services without incurring any liability.

22.2 The Company shall also not be liable for any failure of any equipment or software, however caused, whether under the Company's direct control or not, that may prevent the operation of the Stable Stakes Services, impede the acceptance of entries, or prevent any individual from contacting the Company or accessing the Stable Stakes Website.

 

23. Stable Stakes Competitors Indemnity

23.1 Each Stable Stakes Competitor agrees to indemnify and hold harmless the Company and its associates, affiliates, officers, directors, agents, and employees from any liabilities, claims, losses, or demands made by any third party arising from any breach of the Contract Documentation or from their violation of any law or the rights of any third party.

 

24. Limitation of Liability

24.1 To the extent permitted by law, the Company excludes all representations and warranties regarding the satisfactory quality, fitness for a particular purpose, accuracy, and completeness of the Stable Stakes Services.

24.2 The Company shall not be liable to any Stable Stakes Competitor for any loss incurred as a result of their use of the Stable Stakes Services, including any use or misuse of their discrete Stable Stakes Website password, whether fraudulent or otherwise.

24.3 The Company shall have no liability for any goods acquired by Stable Stakes Competitors with their Winnings.

24.4 Under no circumstances shall the Company's liability under or in connection with the Contract, whether arising from breach of contract, negligence, or otherwise, exceed the amount of the relevant Consideration paid by the Stable Stakes Competitor for the Stable Stakes in respect of which the claim is made.

24.5 Under no circumstances shall the Company be liable for any indirect, special, or consequential damages, loss of profits (direct or indirect), or loss of the benefit of any entry into any Stable Stakes games, whether such loss arises from breach of contract, negligence, or other tort, equitable duty, or otherwise, even if the Company had been advised of or knew (or should have known) of the possibility of such damages or loss.

24.6 Nothing in the Contract excludes the Company's liability for death or personal injury resulting from the negligence of the Company, its employees, agents, or subcontractors.

24.7 Except for any liability that cannot be excluded by law, the Company (including its officers, employees, and agents) is not liable and does not accept responsibility for any loss or damage suffered or incurred by any Stable Stakes Competitor arising from:

(a) entries that are not received or which are received and are subsequently corrupted or rejected by the Stable Stakes Website server, whether or not after receipt by the Company;
(b) any lost, misdirected, or corrupt emails to or from the Stable Stakes Website;
(c) the Stable Stakes Website not being continuously available for use;
(d) any failure of the Stable Stakes Website or incorrect or corrupt data supplied to a Stable Stakes Competitor;
(e) any theft, unauthorised access, or third-party interference;
(f) any variation in the value of any Winnings; or
(g) any tax liability incurred by any Stable Stakes Competitor.

 

25. Right of Set-Off

25.1 The Company may, at any time and without notice, set off any liability owed to it by any Stable Stakes Competitor, including (without limitation) in relation to any account held by the Company in that Stable Stakes Competitor's name or which the Company believes to be under their control, against any funds held in another account kept by the Company in the same or another name that the Company believes to be under that Stable Stakes Competitor's control.

 

26. Intellectual Property

26.1 The Company is the owner of:

(a) all copyright and related rights in and to the Stable Stakes Website, including, without limitation, rights in databases and any data and related content on the Stable Stakes Website, except for certain third-party rights;
(b) all trademarks, whether registered or unregistered, and related rights in respect of the Company logo;
(c) the domain name www.StableStakes.co.uk and www.StableStakes.golf  ("URL"); and
(d) the Contract Documentation, including (without limitation) the COPs.

26.2 Any person making unauthorised use of any of these rights may be subject to prosecution or other legal action, including for breach of contract or tort.

26.3 Stable Stakes Competitors acknowledge, agree, and accept that any data licensed to the Company by third parties, which is used on the Stable Stakes Website, is provided solely for use on the Stable Stakes Website and may not be used for any commercial purposes without the consent of such third parties.

 

27. Promotions and Benefits

27.1 Any benefits earned by Stable Stakes Competitors from a promotion are subject to the terms and conditions explicitly stated in the promotion. Stable Stakes Competitors acknowledge and agree that all promotional offers, including but not limited to bonuses, power tokens, free entries, or other incentives, may be subject to specific requirements, restrictions, or conditions. It is the responsibility of Stable Stakes Competitors to carefully review and understand the terms associated with each promotion before participating. Failure to comply with the stated terms may result in the forfeiture of any benefits received through the promotion. The Company reserves the right to modify, suspend, or cancel any promotion at its sole discretion, with such changes communicated to users through appropriate means.

 

28. Dispute Resolution

28.1 The Company will make reasonable efforts to resolve any disputes or complaints that Stable Stakes Competitors may have regarding the Stable Stakes Services. If any Stable Stakes Competitor wishes to raise an issue with the Company, they should email the Company at support@stablestakes.co.uk
